Sixth Central Pay Commission's recommendations - revision of pay scales - amendment of Service Rules / Recruitment Rules - DoP&T Order

Subject : Sixth Central Pay Commission's recommendations - revision of pay scales - amendment of Service Rules / Recruitment Rules The recommendations of 6th CPC have been considered by the Government and the CCS (Revised Pay) Rules2008 have since been notified on 29th August, 2008. Consequently, in palce of the pre-revised pay scales, the revised pay structure comprising the Pay Band and Grade Pay / Pay Scales has come into effect. Some of thepre-revised pay scales have been merged and some others are upgraded / likely to be upgraded. In the light of these, it has been decided that the following consequential steps to amend the existing Service Rules / Recruitment Rules shall be undertaken on a priority basis:
(i) Substituting the existing scales by the Grade Pay along with the Pay Band
The existing pay scales have to be substituted by the new pay structure (Pay Band and Grade Pay / Pay Scale)straightaway without making a reference to the Department of Personnel and Training (DOP&T) / Union Public Service Commission (UPSC). The heading of column No. 4 of the Schedule on RRs may be modified to :Pay Bandand Grade Pay / Pay Scale". In cases where deputation is also one of the methods of recruitment, the field of selectionfor deputation, which might include various grades, should also reflect the corresponding Grade Pay alongwith the Pay Band / Pay Scale, and the minimum eligibility service as per the revised guidelines, as enclosed in Annexure.
(ii) Where there is an upgradation of posts
The instructions issued by Department of Expenditure under OM No. 1/1/2008-iC dated 13 th September, 208 and DoPT OM No. AB- 14017/66/08-Estt (RR) dated 9th March, 2009 may be applied in such cases.
However, for each of the merged grades, a single set of Recruitment Rules may be formulated and notified.
(iii) Consequential cahanges
It is necessary to make consequential changes in the Recruitment Rules / Service Rules so as to prescribe eligibilityconditions with reference to the revised Grade Pay / Pay Scale. It is also necessary to review other columns of theRecruitment Rules / Service Rules, where some minimum service in a particular scale / grade is prescribed for consideration for appointment on deputation / absorption etc., keeping in view particularly the merger of a number of pre-revised scales, upgradation of some scales and the consequential changes in the minimum eligibility service in a grade.
(iv) Department Promotion Committee (DPC)
Where two or more scales have been merged, the existing DPC for the higher / highest grade will be the DPC for the mergedgrade.
(v) Regulation of regular rendered in the pre-revised scales
The revised pay structure approved includes a number of 'merged grades' with a commn grade pay and the conceptof pay bands with grade pay introduced effective from 1.1.2006. Insofar as the issue of regulation of service rendered prior to 1.1.2006 is concerned, while the general rule may be that such regular service be deemed to be service renderedin the corresponding grade pay / pay scale approved effective from 1.1.2006 or from a subsequent date, as the case maybe, this formulation cannot apply in cases where there has been merger of more than one grade into one with a single gradepay/ pay scale. Since the merger is effective from 1.1.2006 only, even notional benefits of the merger cannot be extended forperiods falling prior to 1.1.2006. A Note to the following effect may, therefore, be inserted under col.12 of the Schedule on RRs, and under relevant provisions in Service Rules, to take care of the requirements:
Note:
For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1.1.2006 / the date from which the revised pay structure based on the 6th CPC recommendations has beenextended, shall be deemed to be service rendered in the corresponding grade pay / pay scale extended based on the recommendations of the Commission. For purposes of appointment on deputation / absorption basis, the service renderedon a regular basis by an officer prior to 1.1.2006 / the date from which the revised pay structure based on the 6th CPCrecommendations has been extended, shall be deemed tobe service rendered in the corresponding grade pay / pay scaleextended based on the recommendations of the Commission except where there has been merger of more than one pre-revisedscale of pay into one grade with a common grade pay / pay scale, and where this benefit will extend only for the post(s) for whichthat grade pay / pay scale is the normal replacement grade without any upgradation.
2. The Recruitment Rules / Service Rules are of statutory nature. Therefore, the changes brought out by other relevantinstructions have to be incorprated in the Recruitment Rules / Service Rules by suitable amendments so that the necessarysteps like holding of DPC etc. are taken to fill the post carrying the revised Grade Pay / Pay Scale on regular basis. All the Ministries / Departments are, therefore, requested to effect necessary amendments to the Recruitment Rules / Service Rulesnotified by them after following the normal procedure of furnishing proposals to the Department of Personnel and Training andthe UPSC in the format prescribed in the general guidelines on Recruitment Rules circulated by the DOPT OM No. 14017/12/87-Estt.(RR) datded 18.3.1988, and also in consultation with the Legislative Department.
3. Ministries/Departments may initiate action to complete the review in this regard and furnish necessary amendment proposals to the DOPT and the UPSC in the case of Group A and Group B posts within six months from the date of issue of this Office Memorandum. They may also, simultaneously, take similar action in respect of Recruitment Rules for Group C and D posts, which are within their delegated powers. Appropriate action to update the Service Ruels for organized Group A, B Services,etc. shall also be taken up with DOPT / UPSC within a peroid of Six Months.

sir, when there is increase of rs 2000 in grade pay SL no 6,11,19 the minimum period required is 10 years but in SL 25 from 10,000 to 12000 increase in grade pay no. of years required is 3. Is it not discriminatory? i am requesting you to clarify.

I,the undersigned working under WPO/KGP Workshop/S.E Railway/Kharagpur, beg to state that thefollowing few lines for Your justification and clarification.
I was holding the post of Jr.Clerk in scale of Rs.3050/- to 4590/- and got the promotion on 13.09.2008 as a Sr.Clerk in scale of Rs. 4500/- to 7000/-. Our pay has been fixed in 6th pay com on Rs. 9730/- ( pay Rs. 6930+GradePay Rs.2800 ) in PB Rs.5200-20200. Where as the Entry Grade Of Sr. Clerk in the 6th pay com is Rs. 8370/- +Grade Pay Rs. 2800/- = Rs. 11170/-.
Hence , we the undersigned are requesting you with folded hands kindly look into the matter and issue necessary orders so that we can get the salary at per entry grade of pay of Sr.Clerk and great monetary lose.

the undersigned personals are working as Assistant Archaeological Chemist in the department of Archaeological Survey of India, Ministry of Culture and we were in the pre-revised scale of Rs.5,500-175-9000/-. with reference to FIRST SCHEDULE- Part-C(revised Pay structure for certain posts in Ministries, departments and Union territories- section-II) of Gazette Notification.Our posts are mentioned in the coloumn 2 under the sub-Head of MINISTRY OF CULTURE with the grade pay of Rs.4,600/-.Eventhough we are receiving 4200 as grade pay, due to misprinting of pre-revised scale in the coloumn 3. so, we request you to kindly look into the matter and issue necessary orders so that we can get the grade pay of Rs.4600/-.

Sir we were working in the CSIR (councial of scientific and Industrial research) as Junior Technical Assistant (pre revised 5000-8000)since 2001. After complition of 5 year we have got promotion as Senior Technical Assistant in 2008 from our due period July 2006 by back date in the (pre revised 5500-9000) scale. However, these two scales are merged in teh sixth pay commission. But we are not clear that, if we got promotion after implimantion of sixth pay commition only from our earlier position to senior position. But our department have not given any benifit to us. the grade 4200 which was earlier in junior position we were getting the same grade 4200 now getting after promotion. We are not understanding that the juniors who is joind after 9 year from us he is also getting the same salary, and after promotion we also getting the same salary. What does the promotion mean? Sir look in to the matter and suggest please. Since we have promoted to senior position only after implimentation of sixth pay commisision.

Gr. C/II Stenos of CSSS are given the grade pay of Rs.4200. In the Subordinate Service, the said GP of Rs.4200 is attached to the posts of Stenos. Gr. II/Gr. I, etc.
Now anomaly exists with regard to the GP of Private Secretary in the Subordinate Service. Private Secretary in the CSSS is given the GP of Rs.4800 and with 3 years's residency, they are given the GP of Rs.5400. Whereas in the subrdinate service, there are perceived anomalies with lower Grade Pay of Rs.4600 which needs to be abolished/removed. In keeping with natural justice, Stenographers' Cadres in the Subrdinate Service should be restructured on CSSS pattern.

Otherwise, the principle of equality enshrined in the preamble of Constitution is meaningless for the Subordinate Stenographers' Service. Hence, the Stenographers Cadre of the Subordinate Service has to be re-structured on CSSS pattern.

The Grade Pays of Stenos in the CSSS are as under:
Steno Gr.D/Gr.III - 2800, Steno Gr.C/Gr.II - 4200, Private Secretary - 4800, PS with 3 years service - 5400.
It may be stated that the pay commission has strongly recommended for parity with CSSS in respect of Stenos Cadres of the Subordinate Service and also for due restructuring of the latter cadre. However, such a valid perception is not given effect with reg to PS and above in the Subordinate Service. Therefore the Cadre of Stenos in Sub Service may pl be restructured keeping in view the above facts and on the same patter as CSSS.

selected in rlys.through rly.service comm. in scale 260/400 as office clerk in1979.in the year 1985 selected as traffic apprentice by rly. service commission through proper channel.at present wkg. in sale 9300/34800 withgrade pay4600/.please tell me my new grade pay after macp as length of service is more then 30years from entry ingrade 260/400 but from entry in 425/455/700 astraffic apperentice is more then 25 years.

Sir,

I am a physical disabled and working in a PSU as a Sr. Steno in scale of 10700-20600.

on getting the transport allowance double the normal rate I cross the 50% ceiling of perks and not getting other perks like Children Education allowances, LTC etc.

are there any guidelines regarding exemption of this transport allowance of double rate.

pl advise or give any BPE guidelines

PS as per govt. policies in transport allowance rebate in income tax is alos double

TIME BOUND PROMOTION may granted to Civilian Motor Drivers (Staff Car Drivers) as CMD Special grade forthwith who are completing 3 years in the grade of CMD grade I .
Or

The grade ratio of CMD (Special grade) may be revised into 40% instead of 5% with the implementation of three grade structure by merging the CMD Gde I and Special Gde into one grade in the ratio of 30:30:40 as the 40% senior most CMDs are having more than 24 years of regular service.

If employee gets promotion in April then wt is the promotion policy and if he gets promotion in 1st July then wt is the promotion policy as per 6th CPC...kindly clear my doubt.

Sir,
When I was drawing basic pay of Rs8500/- , I was eligible for Type IV accommodation during Vth pay commission, after VIth pay commission I was put in GP of Rs.4600/- and now became eligible for Type III accommodation. I want to know that why this type of discrmination is being done ? If system or Recruitment rule is faulty and the individual is not given promotion , then this type of humiliation will also demoralise the member which ultimately effect the working of the employee and functioning of the organisation. It is humbly requested that during anamoly committee meeting this issue may kindly be raised and those having basic pay of Rs.8500/- on the date of order of VIth pay commission should must be eligible for type IV accommodation.

Now 20% in Group D and 10% in Group C posts are reserved for Ex-serviceman but Ex-serviceman are not getting the proper reservation
quota due to attitude of Civilians involved in recruitment process and
there is not any roster are being maintained in many departments. The
Government orders already exist to carry forward unfilled vacancies
for Ex-Servicemen to the next year is also not being implemented by
the departments. Due to lax policy Ex-serviceman are suffering and not
getting due advantage. After 6th Pay Commission all the Group D posts
merged with Group C posts and some of Group C posts up graded to Group
B posts. So this matter must be raised in Parliament and due amendment
may be passed to replace the words Group D by Group C and Group C by
Group B immediately

After implementation of 6th CPC in all most all departments/ministries revised pay is introduced and old pay scale is abolished. But in Ordnance Factories for Industrial Employees still Pre-revised pay is applicable for Piece work payment. Similarly Night Duty Allowance is still not revised. It is difficult to say that some intelligent persons are sitting on higher post to make and decide polity matters.
