National Anomaly Committee meeting - Decisions & Discussions

The third meeting of the National Anomaly Committee was held on 15/02/2011. The following items were taken up for discussion. No final decision on any item could be arrived at. It was more or less an exercise to understand the points of view of both sides on these items. We shall in our next communication indicate the outcome of discussion on each item.

Item Nos. 11, 12&13, 14, 20, 28,29&30, 31,37, 38,39, 40, 41, 43, 44, 45, 46, 49, 50 and 51.

During the discussion the Staff brought to the notice of the official side that the issues pertaining to the employees of Andaman and Nicobar islands, which were taken out of the agenda on the plea that the same would be discussed separately by a Committee to be set up by the Andaman Administration have not been settled. The NGO Association of A & N Islands have brought to the notice of the staff side that the A & N Administration has not taken any steps to resolve the problems even though similar issues pertaining to the employees of Pondicherry and Delhi were settled. The Official side has promised to take up the issue with the concerned in the Home Ministry to ensure that the issues are addressed expeditiously.

The official side has in the Action Taken State has indicated their inability to concede the demand raised by the Staff Side on the following two issues.

(a) Grant of increment in the case of employees whose increment falls between Feb and June. 2006.

(b) Fixing the pay of the promotees on par with the Direct recruits.

Though these issues were not discussed, the Staff Side has said that a resolution to them are urgently needed.

The official side has requested the Staff Side to indicate the items on which further discussions are needed; further details are required; and alternative suggestions could be made within 10 days so that the next and final meeting of the Committee could be convened before 31st March, 2011. It was also decided that the sub-committee of the MACP related issued will meet once again and their report submitted to the NAC .

Outcome of III NAC meetings came as a shock to me . we have waited for four years to get this issue resolved . I joined in february 2004 & my friend joined in january2004 . Because of VI pay commission two things happened
1) My friend received one increment more & then his pay was fixed. Now each year difference in gross salary is widening.today approximately the difference is Rs. 1300/- & this will keep on increasing because of 3% increment.
2)In a single stroke i was made junior by one whole year as difference of one increment would indicate.
So i would like to ask esteemed members of NAC is it not fit case of anamoly happening with persons of same batch & recruitment year but joining in different months.I would urge staff side to take up this issue as this is against principle of parity. In the first place their was no need for fixation of pay after giving increment in january if uniform date of increment had been fixed as july. but since that has happened kindly step up the pay of person who had their increment between february & june 2006

Govt. is only lingering on the matter and waiting for the next pay commission. They will accept it by that on with notional fixation w.e.f. 01.01.06 and financial benefit from the date, when the 7th pay commission report is implemented. This is the Govt. strategy.

since clerical staff is also dealing with sensitive subjects like maintaining service books, leave account,finance matter like pay & allowance, pension maintaining of gpf,medical,ta/da and ltc & budget,etc they should be considered for gp Rs. 4,200/-.

Sir, big anomaly in the pay scale/grade pay of Library Information Assistant(LIA), after implementation of 6th CPC.

*The Library Information Assistants are placed in the grade pay of Rs.4200/-.

and

*school Librarians, TGT and Physical Education Teachers are placed in the grade pay of Rs.4600/-.

This is big anomaly of LIAs pay scale and pay band.

The above referred anomaly existed in the 5th CPC too. That is, school librarians were placed in the pay scale of Rs.5500-9000/-, whereas the Library Information Assistants were given the pay scale of Rs. 5000–8000/- initially.

This anomaly was removed by the Ministry of Finance vide its Office Memorandum No. 71/3/2001-IC, dated 21. 2. 2002, and placed in the pay scale of Rs.5500-9000.

It is stated that the Library Information Assistants School Librarians, Trained Graduate Teachers, Physical Education Teachers are require minimum educational qualification (3 year Graduation degree + one year Professional degree)i.e .B.A/B.Sc/B.Com.+ B.Ed./ B.P.Ed./B.Lib.Sc. Above all minimum educational qualifications are same, but grade pay different.

WHY?

Hence it is justified that the Library Information Assistants deserve to be placed in the grade pay of Rs. 4600/- (from 01/01/2006).

This anomaly may kindly be looked into seriously. I request to the National anomaly committee (6th CPC) to render natural justice to the Library Information Assistants (LIA).

THE OUTCOME OF III ANAMOLY MEETING AS REPORTED, HAS DISHARTENED ME. HOW CAN GOVT DENY THE BENEFIT TO THOSE WHOSE INCREMENT FALLS BETWEEN FEB TO JUNE. IS IT NOT DISCRIMINATION? ONE SECTION WHOSE INCREMENT FALL ON AUG TO DEC WILL GET INCREMENT FROM JULY BUT FOR OTHER IT IS NIL. GOVT SHOULD THINK JUDICIOUSLY WITHOUT THINKING FOR MONETORY INVOLVEMENT. THIS BENEFIT IS MORE THAN MONETORY INVOLMENT TO THE GOVT EMPLOYEES. STAFF SIDE SHOULD STICK TO HIS PRESSURE ON THE GOVT IN THE MATTER.

Fixing the pay of the promotees at par with the Direct recruits.
Why this matter could not be discussed even after 3 years. This matter is very obvious that SAME WORK SAME PAY supported by constitutional articles and Hon'ble Supreme Court decisions from time to time. There should be same entry level pay for direct recruits and promotees. Government why creating distinguish between direct & promotee even both have same work. It is also wrong to say that when a direct person appointed in same gradation list post then promoted person stepped up to direct recruits. But what about its service before this and why he deprived of pay till direct appointment. Also there are many departments(e.g.,IA&AD) in which a post with both of direct and promottee exists with same work but in its sub offices some have no post of direct recruited person in gradation list but on the other hand in other sub office direct recruitee post exists and promotee stepped up after appointment of direct.So please draw common view that EACH GRADE PAY HAVE IT'S OWN MINIMUM/ENTRY LEVEL WHICH PROVIDED BOTH TO DIRECT & PROMOTED. ALSO MR. kUTTY BEING OUR REPRESENTATIVE PUT IT STRONGLY BEFORE ANOMALY COMMITTEE.

Sir, After waiting for a long time and to have a NIL report on the subject meeting is very painful. We strongly hope that LDC-UDC grade pay issue also is included in the agenda. It is once again requested that the above point may please be taken since all the pay commissions have done enough injustice to the clerical cadre.
Tax Assistant of Income tax drawing grade pay 2400 at par with UDC whereas Tax Assistant are more qualified than UDC because T.A. possess minimum qualification of graduation plus 8000 key depression speed on computers.

Again LDC qualification Inter drawing grade pay 1900 whereas Notice Server of Income Tax minimum qualification Matriculation are drawing grade pay 2000/-.

But who cares for Pity clerks.

But it is very very happy to note the following report "that the issue which is very important from our point of view - that is increment from January for those whose increment falls between February and June was taken yesterday(on 16.2.2011) by the Confederation again and raised this issue, and after prolonged discussions, the Secretary, DoP&T had agreed to review the matter. An indication has also been given that if Staff Side agrees for one time exemption, then the issue can be resolved"

We, the affected officials request the govt to take a favourable decision on this issue and we all agree taking it for one time exemption.

We all pray that the Central Govt Confederation will take all efforts to achive this feb to june increment issue favourably.

Article 14 is absolutely violated by "non-application of mind" while considering to allow increment to the employees whose date of increment falls between 1st February to Ist June of the year while fixing pay from 01.01.2006 and certainly they would attract the attention of the Suprement Court in this regard.

THE ISSUE OF INCREMENTAL BENEFIT FROM 01-01 FIRST JANUARY TO THOSE WHOSE INCREMENT FALLS (PRIOR TO 01-01-2006) BETWEEN FEB TO JUNE SHOULD BE SETTLED IN THE NEXT ANOMALY COMMITTEE MEETING TO BE HELD BEFORE 31-03-2011. ISSUE OF GRANTING QUALIFYING PAY TO THE ACCOUNTANT IN AUDIT AND ACCOUNTS DEPARTMENT FOR PASSING THE DEPARTMENTAL CONFIRMATORY EXAMINATION SHOULD BE REVIEWED AND TO BE AT PER WITH THE RAISE OF SCALE OF PAY AFTER 01-01-2006. STAFF SIDE SHOULD INSIST AND GET THE DEMAND FULFILLED AS WAS DONE BEFORE. WE HAVE FAITH ON THE STAFF SIDE REPRESENTATIVES.

The issue of those whose increment falls prior to 01-01-2006 between February to June should be settled in the next anomaly committee meeting to be held before 31-03-2011. I request to National anomaly Committee to render natural justice and get the demand fulfilled

It is really good to hear that the Department side have agreed review the matter of grant of increment for those employees whose increment falls between feb and June. This will wipe away the discrimination meeted out while implementation of 6th CPC. I request the staff side to get this implemented in the next meeting as a one time benefit. Further I also request the staff side to take up the matter of Grade Pay to LDC & UDC as the same is very less when compared to Group D & MTS who are getting Rs.1800/- instead of Rs.1300 earlier to their training. The GP of LDCs and UDCs should also be increased to Rs.2800.00 w.e.f. 1.1.2006.

I kindly request the staff side to get the issue settled relating to those whose increment falls between February 2006 to June 2006 in the next anomaly committee meeting to be held before 31-03-2011. I request to National Anomaly Committee to look into the issue and get the demand fulfilled. For no mistake / reason, I am losing one increment.

sir, it is very unfortunate that semi professional assistant(required qualification is Graduate with BLISc & Computer) is belonging to the scale of Rs. 5200-20200/- with GP Rs. 2800-/. Pl.to keep off this anomaly and to keep up the transparency the SPA shoul immediately be upgraded to Pay Band 2. In comparison with other all the SPA is still deprived. Pl. look into the matter and find positive measures. Thanking you. Sukumar Das. Santiniketan. W.B.
