National Anomaly Committee agenda item 8.3 : Non-issuance of orders by the Finance Ministry - NFIR

NFIR General Secretary writes a letter to DoP&T and Finmin pertaining to that the Railway staff continues to face hardship due to non-issuance of orders by the Department of Expenditure, Ministry of Finance, for the decision on the agenda item 8.3 has been taken in the National Anomaly Committee, which was held on 17th July, 2012. The letter has been uploaded on its official website and we have reproduced full text of the letter and given below for your information...

Sub : Item No.5(ii),(iv)(with 32&33),(v)(vii) - Rule 8 of the Revised Pay Rules Fixation of pay on promotion - minutes of the meeting of the National Anomaly Committee held on 17th July, 2012 - reg.

A large number of staff working in the Central Secretariat Services including the Railway Board have represented to the NFIR that though the decision on the above item has been taken in the National Anomaly Committee meeting held on 17th July 2012, the staff contiunes to face hardship due to non-issuance of orders by the Department of Expenditure, Ministry of Finance.

In this connection, attention is invited to the minutes of item No.8.3 of the meeting referred to above, extract of which is given below :-

"Staff Side stated that anomaly in this case is basically due to the fact that it is for the firs time that CPC has recommended specific entry level pay for Direct Recruits (DRs). This has resulted in employees who were appointed in service prior to the DRs and got promoted earlier getting less pay as compared to their counterparts recruited directly and who joined after 01.01.2006. The Official Staff stated that in such cases stepping up of pay is permissible subject to certain conditions. However, the Staff Side insisted that on promotion, the pay of all the promotees should be fixed at the entry level of pay of the post as in the case of the direct recruits  wherever there is a provision of direct recruitment in the RRs.

The Staff Side requested that in cases where no direct recruitment actually took place even though RRs provided for the same or when a DR did not join, stepping up of pay should be considered.

This suggestion of the Staff Side was considered by the Official Side, who responded by stating that wherever there is a provision of direct recruitment in the Recruitment Rules, pay on promotion would be fixed at the prescribed minimum of the Entry Pay as provided for the Direct Entrants in the Revised Pay Rules, irrespective of the fact whether direct recruitment has actually taken place or not. The Staff Side agreed to close this issue thereafter."

The NFIR, therefore, requests that necessary clarification may kindly be issued at an early date to rectiry the anomalous sitation. A copy of the instructions issued may be endorsed to the Federation.

Who is responsible for delaying such a crucial issue pending for a period of 4+ years after implementation of 6th CPC ? Is he/she concerned about the welfare of employees ? Intervention of all the Association is urgently needed.

Central Govt Employees are not digest that why Central Govt. is delaying to publish the order in this regard. it may be issued immediately as it is accepted in anomaly committee meeting.

It's more than 5 months. How long will they take to issue an order? Many promotees who have suffered are eagerly waiting for this order. Whether the implementation will be done from 01/01/2006? Time has come for the Federation to intervene and get the orders quickly.

I am waiting for the orders in this regard for the last 2 yrs after my promotion. Staff unions may please take up this non-issuance of orders with the government and force them to immediately issue clarification for the delay

Orders on this matter will not going to be issued as finance ministry has rejected the proposal regarding minimal entry pay as decided in the nac meeting. it's true.

I wish to bring you in notice that Resolution containing govt. decision on sixth CPC report on 29 Aug. 2008, have some Contradiction in Hindi and English version on the point related to uniform date of increment. where the hindi version says that the govt make amendment in CPC report regarding uniform date of increment and there would be two uniform date of increments i. e. 1st Jan or 1st July but the English version says that govt. agrees with the CPC so there would be only one uniform date of increment on 1st July. please clarify the pint because if the govt. had made it get benefit to lot of new appointees who join his post from jan to july of every year.and also it avoin a lot of Anomaly in this regard.

It is heard that DOPT has rejected the recommendation of Anomaly committee. Hence, it is not issuing any order. This is injustice to the promottee.

it is highly injustice for promotees. It is too late. JCM should pursue the matter with DOPT and Fin. Min. for early issue of orders. some departments not even stepped up the pay of promotees up to the level of direct recruitee. it ia a mental agony for all promotees.

I have gone through the noting of the Finance Ministry which has been supplied to the RTI applicant. From the noting it is clear that unless the matter regarding non admissibility of entry pay of Direct recruitee to the promotees is move to the Court for justice, the same will remained forever.
