Record Note of the meeting held Qn 24.10.2013 at 3.00 PM to discuss the possible Terms of Reference (ToR) for the 7th CPC with the representatives of the Staff Side of JCM

A meeting was held on 24.10.2013 at 3.00 PM in Committee Room No 190, North Block under the chairmanship of Dr S.K.Sarkar, Secretary DOP&T to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, which is going to be set up by the Government, with the representatives of the Staff Side of JCM. List of Participants to this meeting is at Annexure I.

At the outset, Secretary (P) welcomed the Staff side representatives and thanked them for attending this meeting on a short notice. He indicated that since this meeting has been convened to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, he hoped that the discussions would remain so focused.

Sh Umraomal Purohit, Secretary, Staff Side, in his opening remarks stated that it would have been preferable that there was a proposal from the official side on this issue to the Staff Side and then the same could have been discussed further in a meeting where the Finance Secretary could also be invited. He then pointed out that the new concept of Pay Bands and Grade Pay structure as per the 6th CPC, which changed the pay structure in Government, had resulted in a new experience which was mixed. He stated that though the 6th CPC did not recommend merger of DA with Pay, they could not have anticipated such a high rate of inflation which resulted in such high rate of DA; the rate of Dearness Allowance presently was 90% and due to high inflation there was a need to consider merger of a part of DA with Pay. He also raised the question of Interim Relief pending finalisation of 7th CPC recommendations. Shri Purohit further mentioned that anomalies of 6th CPC should be resolved on priority before 7th CPC. He also suggested that there must be some machinery which should resolve anomalies within one year of implementation of CPC report.

M.Raghavaiah, while thanking the Chairman raised the issue of anomalous situations which had arisen due to the new concept of Pay Bands and Grade Pay structure as per the 6th CPC. He suggested that the Finance Ministry should look into this aspect as to how anomalies cropped up due to this and how these can be avoided in future. He was of the view that the anomalies cases which stand referred to the Ministry of Finance need to be cleared. He referred to anomalies relating to MACP scheme vis a vis ACP scheme and resolution pending thereon required to be resolved as already discussed in the Joint Committee meetings on MACPS. He also demanded that there should be merger of DA with Pay as was agreed to in 2004. He also
pointed out that the Railway Ministry’s proposals on 6th CPC related matters presently pending with Ministry of Finance should be cleared.

The other representatives from Staff Side raised the following issues

1) Entry level pay to promotee employees at par with that admissible to Direct Recruits as was agreed in the National Anomaly Committee;

2) One of the ToR should be to set up a special bilateral mechanism to sort out anomalies arising out of Pay Commission recommendations;

3) Professional approach should be adopted in dealing with peculiarities concerning Railways and Defence civilian employees;

4) There should be parity between pre & Post CPC retirees for the purpose of pension etc.;

5) Cadre review/restructuring proposals should be delinked from the 7th CPC so that these are not delayed;

6) Wage Revision should be effective after every 5 years as in the case of PSUs;

7) If there is going to be separate CPC for the Armed Forces as had been reported in media, or if there is a representative of Armed Forces in the 7th CPC then there should be a representative of Labour in the CPC;

8) CPC should not go by “Central Secretariat” structure to make its recommendations which does not take into account specific complexities in large Government organisations like Railways, Postal Department and Defence establishments.

9) Allowances should be enhanced concurrently with the pay consequent upon Pay commission implementation.

10) Supreme Court has upheld that MACP should be in the hierarchy of the Post and also for grant of NDA in 7th CPC rates w.e.f. 1/4/2007. These judgments should be implemented to all similarly placed employees.

11) The Secretary Staff side in the end requested that a copy of Terms of Reference as proposed by the Ministry of Finance may be circulated and then another meeting with Secretary, Department of Expenditure and Department of Personnel & Training be arranged to discuss & finalise the Terms of Reference of 7th CPC.

In his concluding remarks, the Chairman thanked the participants for their views and requested the Staff Side that they may send their suggestions in writing also.

I'm an employee of Defence Accounts Department. I've been appointed as Auditor in 02/05 and got promoted as an SO(A)/AAO by clearing departmental exam (SAS) on 02/09 and one increment has been given for promotion. In the other hand, my junior (appointed as Auditor in 05/05) got promoted to Sr. Auditor in 04/09 and further promoted as SO(A)/AAO by passing same exam on 10/09. He got 2 increments for 2 promotions and thus drawing more than me. What was my fault ? Clearing the exam. like SAS within less span ? Curse on them who are inactive on the issue of ENTRY PAY for DEPARTMENTAL EXAM (SAS, LDCE, GDCE etc.)!

IT IS SEEMS THAT THERE IS NO TIME BOUND PROMOTION IN ADMINISTRATIVE STAFF SINCE 2006 ONLY GRANTED MACP IN SIXTH CPC, IF THERE IS VACANCY THE OFFICE DEMANDED IN THE 5/10 YEARS REGULAR SERVICE, NOT MACP GRANTED PERSONS EVEN HE IS MORE THAN ABOVE PERIOD WHICH CAUSED A GREAT LOSE IN THEIR SERVICE PRESENT IN FUTURE . AS I AM A ICAR EMPLOYEE SINCE 29.02.1988 AND GOT PROMOTION IN SR.CLERK ON 10.12.2010 MORE THAN 22 YEARS, IT IS VERY SERIOUS TO LIVE IN A SOCIAL COMMUNITY AND PEOPLE ARE TELLING LIKE THAT THAT A YOU ARE A CENTRAL GOVT. EMPLOYEE AND LIVING IN A SUPPORTING STAFF STATUS. THERE IS A POSITIVE THINKING TO GET MORE BENEFICIAL TO LOWER STAFF.HE IS ALWAYS IN A DEPRESSED MANNER WHO IS LIVING ONLY FOR CHILDREN. AT THE PRESENT TIME HOUSE RENT BECOME VERY HIGH. THE HRA SHOULD HE AT LEAST 50% OF BASIC PAY. FURTHER TRANSPORT ALLOWANCE SHOULD ALSO INCREASE ATLEAST 5000/- + DA.
EVERY EMPLOYEE SHOULD BE GIVEN INCENTIVE FOR GOOD WORK EVERY YEAR. PAY COMMISSION SHOUND BE IN EVERY 5 YEARS.
FOR THE LTC,FIXED ALLOWANCE PER YEAR MAY BE GIVEN.

Selection grade of Assistant,IT Inspector,custom excise Inspector, Commercial Apprentice & Traffice Apprentice (Railway)was 5500-9000 in 5th CPC but later selection grade of all except CA&TA enhanced to 6500-10500. Since CA& TA remained in 5500-9000 pay band, therefore, 6th CPC also recommended its selection grade pay Rs. 4200 instead of 4600. This is injustice. Please see.
i am deffence civillian employee i have to do night duty after every four days for it we receive night allowance but we are getting night allowance accordinge to fourth pay commission so please grant night allowance according to six pay commission we are also notgeting weekly off so please take neccessary action

In Scientific Organisations like CSIR, there is concept of FCS (Flexible Complementing Scheme) for Scientists and Technical staff. Under FCS the S&T staff get promotion after every FIVE years irrespective of availability of vacancy. Even the helpers classified as technical get promotion after every Seven years. However the Administrative Staff get their promotion only when the posts are vacant (In some cases they get promotion after 22 years).

The same scheme should be adopted for all the government staff instead of ACP and MACP.

proportionate pension should be granted on the completion of 10years(30% ), 15years(40%) 20years(50%) of service the . so, that employee who is not in a position to continue his/her service till 20 years due to medical/family problems have a right to leave with pension.

Sir, Please hike the pay scale of LDC & UDC as we are the most affected people with no raise in grade pay and not following the hierarchy while enhancing the monitory benefit under MACP. Where there were change of Grade pay in lower level and higher level, UDCs scale was never touched with any changes. Please look into the matter and justify in 7th CPC.

I SUSHIL PUROHIT am working as an assistant commandant in BSF (CPO).sir, I want to draw your attention that there is a huge stagnation in promotion due to no enough vacancies in upper ranks. officers of 24 batch of ACDE are still dc and 32 batch has been promoted on same post. My question is that is this our fault that after putting so much hard efforts to ensure security of our sacred mother land why not paramilitaries /cpos of our nation do get respected pay and facilities? We almost do equal duties like ARMY does. than why an young army officer who is drawing 65000 at entry level along with free accommodation/hra, free ration,a good canteen facilities so much many things and we are not. Is this discrimination is valid? Should we (all cpos) not be benefited with such facilities? We are hopeless completely and our moral is lost due to this injustice. Due to this many many young paramilitary officers are quitting the job and choosing low pay band jobs. I think this is not a good sign for our national security... kindly consider this .. thanking you sir...

LTC rules to be relaxed. Spouse (working in Central Govt.)of Railway Employee also be given the benefit of LTC independently. If both husband and wife are railway employees both enjoy the Railway concessional pass and P.T.O. independently. In other CG departments too husband and wife can take LTC independently. This is injustice to some CG employees whose spouse is employed in Railways. I appeal Association Leaders this matter to be taken up with 7th CPC please.

Sir,
I am Sajeev working in Railways. I appreciate the 6th PC for introducing CCL for women employees. Also for Men employees who really figting to meet the ends for the daily needs of his family should also be appreciated by granting OPCL (Old Parent Care Leave) atleast when their old parents are really sick or hospitalised or in bed ridden condition. Parents are also taken care of in equal manner that of children. Hence, I request the 7th PC to consider Old Parent Care Leave to take care of old parents who have sacrificed their entire life period for their children. It will be not only a boon to the parents but also to the nation. Please consider this aspect.

Sir, first of all thank you very much to raising the problem of LDCs Grade pay. Sir, in any office of the government sector The LDCs pay his important role to going official work smoothly to do their work very accurately and speedily but what is he given by the department or Govt. or what kind of reward they given. Nothing . But they only require to give some for this entitled actual honour is grade pay. which is their right bt is also ignored by the government. So, many many thanks to you for raising the problems of LDCs and UDCs working in the same department. Thanks !

Sir, Please see about the grade pay of LDC, it is very low. A Centrally Controlled Cook get same GP which is same as LDC Rs. 1900/-
In this same post state govt has given Rs. 2600/- gp.
Please consider this aspect and do some fruitful which will be best for LDC personnel.
Sir I MUTHUKUMAR working in RAIL WHEEL FACTORY BANGALORE request you to kindly include in 7th pay commission, MACP should not be limited to 3 times in a service , if an employee works for a continues 10 years in the same grade, he should be given an MACP, because in most of the grades it is getting stagnated. and the employee is working for more than 15 to 20 years in the same grade

 INCREASE IN THE PERCENTAGE FROM 5% TO 20% CMD( SPECIAL GRADE )at par with MCM and redesignate as forman of transport as in Navy :-
The grade ratio of CMD (Special grade) may be increased from 5 % to 20% with effect from 01.01. 1996. Or TIME BOUND PROMOTION may granted without considering the availability of vacancy

i am an employee of ordnance factory Defence establishment . I have been appointed as pharmacist in June 1982. there is no time bond promotion in our cadre . There is no difference in the status of a pharmacist who is working for last 30 years and a newly appointed. I request you to include this matter in 7th CPC for serious consideration.

1. At present I am working as a vehicle mechanic in the department for the last 9 years. To my belief, I have served the department sincerely, diligently and obediently sans any complaint of dereliction of duty of any kind. No promotion has been granted to me till date since my service in the above post and I am also constrained to submit that unreasonable discrimination persists in pay scale and other benefits comparing to Charge mechanic, SKT, LH (NT) and LDC post.

2. As per every vehicle mechanic appointed in the organization, requirement of initial recruitment qualification (As per 1982 RMP Rules ) ,have a passed SSLC and also ITI certificate (NCVT).that I am qualified enough to be a CHARGE MECHANIC. On a perusal of my pay scale, I am drawing a grade pay of Rs. 1900/- as against grade pay of Rs.4200/- drawn by a charge mechanic. More over the benefits enjoyed by a Charge Mechanic also differs than that of a vehicle Mechanic. As far as the work is concerned, basically there is no difference between a vehicle Mechanic and a charge mechanic; both are doing the very same work.
At the very same time, those who are holding the post of SKT, LH ( NT ), and LDC having lower qualification (requirement of initial recruitment qualification only for SSLC )(As per 1982 RMP Rules) compare to Vehicle mechanic draws very same grade pay of RS 1900/- and they are also enjoying much more benefits especially havildar Ranks, NCO MESS, and other allowances etc. Thus, your Honour would find that there exists a sheer injustice to be intervened and mend at the earliest otherwise I will be put too much hardship and mental agony.

3. Moreover 8th class passed a store man recruited in this organization is promoted to BS-1 (senior supervisor) (As per 1982 RMP Rule) after 25 to 35 years service, where as a V/Mech/ electrician. In this department with higher qualification retires with the same rank even after putting in 25 to 35 years service. Where is natural justice?

In DRDO, there is drtc cader, in which promotions, are based on accessment after 5 years residency, some get promotions in first attempt i.e. in 5 years, where as many not get, if not passed in assessment, even appearing 4,5,7....8,10...so on times, i.e. not time bound. MACP is also not given to them on completion of 10 years of service in same grade from entry point. Is it justified? Please answer?
