Subject: Recommendations of 7th Central Pay Commission -Applicability to the pay scales of Casual Labourers with Temporary status.

The undersigned is directed to say that on the implementation of the recommendations of the 7th Central Pay Commission as per Government of India Notification dated 25 th July, 2016,
the Casual Labourers with Temporary Status will continue to receive their wages with effect from 01.01.2016 as per provisions of the Casual Labours (Grant of Temporary Status & Regularisation) Scheme, worked out on the basis of the pay scales of Group ‘C’ as per Level 1 of the Pay Matrix recommended by the 7 th Central Pay Commission and approved by the Government provided they are matriculate. In case of the similarly placed non- matriculate Casual Labourers with Temporary Status the above benefit of wages w.e.f. 01.01.2016 may he extended only after imparting the requisite training by the respective administrative Ministries/Departments on the lines indicated in the MOF O.M. No. 1/1/2008-IC dated 24.12.2008.

2. This issues with concurrence of M.O.F. I.D. No. 4-17/2017-IC/E.IIIA dated 07.02.2018.

Dear Sir,
Sub: Denial of Leave Salary duly reckoning 30% of 7th CPC pay for Running Staff-reg.

The extant instructions provide that the Running Staff are entitled for payment of Leave Salary duly reckoning 30% of pay. It has, however, been represented by our affiliates as well staff that on many Zonal Railways 30% of 7th CPC pay is not being reckoned for the purpose of payment of Leave Salary to the Running Staff. When pointed out, the Zonal Railways stated that Board’s clarification is awaited.

In this connection, NFIR desires to state that Leave Salary is not part of Allowances, therefore, 30% of 7th CPC pay needs to be added to the Basic Pay ior the purpose of payment of
Leave Salary to the Running Staff. In view of confusion prevailing on certain Zonal Railways, the Railway Board may consider issuing suitable clarification for reckoning 30% of 7th CPC pay
for the purpose of payment of Leave Salary.

NFIR, therefore, requests the Railway Board to issue clarificatory instructions as suggested above, duly endorsing copy thereof to the Federation, at the earliest.

Subject: Recommendations of 7th CPC with regard to EDP Cadre — reg.

The undersigned is directed to refer to this Department OM of even number dated 17.10.2016 and subsequent reminders dated 30.11.2017 on the above mentioned subject wherein Ministries/Departments were requested to furnish information on the following points:-

(i) Whether EDP cadre is existing, if yes, the hierarchy and the strength in each grade/level thereof;

(ii) Copy of the existing Recruitment Rules for all the levels;

(iii) Suggestions, if any, regarding the cadre re-structuring in the cadre;

(iv) Comments on the recommendations of 7 thCPC.

2. Even after lapse of a considerable period information has been received from very few Ministries/Departments. Therefore, it has been decided to hold a meeting with all Ministries/Departments under the Chairmanship of Sh. G. D. Tripathi, Joint Secretary (E), DOP&T in Room No. 190, North Block, New Delhi on 27.02.2018 at 3.00 PM to discuss the issue relating to the recommendations of the 6 thCPC on the issue of Electronics Data Processing (EDP) Staff and the way forward on the same. Ministries/Departments are requested to depute an officer of appropriate rank who is well conversant with the subject matter to attend the meeting. It is also requested that information on the above points may also be brought if the same has already been not forwarded to DOP&T so far. A copy of the extract of the recommendation of the 7 thCPC is also enclosed.

Kind attention is invited to the instructions issued by the Railway Board vide RBE No. 71/2016 dated 21/06/2017 and 34/2017 dated 12/04/2017 wherein decision has been taken to reserve 2% vacancies against direct recruitment quota in Pay Level-l of 7th CPC pay matrix from amongst Course Completed Act Apprentices trained by the Railways.
In this connection, Federation has come across the Centralized Employment No. CEN 02/2018 (published on 10/02/2018 and Closing date 12/03/2018) wherein the Course Completed Act Apprentice trained in Railway establishments have been allowed to compete along with other outside candidates (Para 12.0 of the notification may be seen) for which respective RRBs have been entrusted the job to recruit the candidates for the Zones to which the requirement is to be catered for. In this connection, Federation conveys that this process is time consuming and the designated RRBs are likely to take more than six months to finalize the panels. The Zonal Railways on receipt of the panels will take further period of about 2-3 months to get the selected and empanelled candidates medically examined for issuing posting orders.

In order to ensure quick availability of candidates, Federation suggests that the quota of 20% vacancies in respect of Railway Act Apprentices may be allowed to be filled by the Zonal Railways directly without linking to RRB/RRC recruitment process.

NFIR, therefore, requests the Railway Board (CRB) to kindly arrange to review the matter and see that instructions to the General Managers are issued for inducting Course Completed Act Apprentices to the extant of 20% vacancies in Pay Level-l of 7th CPC Pay Matrix without linking to the recruitment process conducted by RRBs/RRCs.

Federation may kindly be kept advised of the action taken in the matter.

Permission for Investigations/Treatment Procedures

No Permission is required for getting listed Investigations/ Treatment Procedures done at the CGHS empanelled Diagnostic Centres/Hospitals, if prescribed by CGHS Medical Officer/ CMO
Incharge or Government Hospital specialist.

Listed Investigations/Treatment Procedures prescribed by a specialist of empanelled hospital need to be endorsed by the referring CGHS Medical Officer/ CMO Incharge, however permission is not required in this case also.

For unlisted Investigations/Treatment Procedures permission is required from the AD of the City/Zone in case of pensioners and Head of Department/Office in case of serving employees. However for pensioners of Autonomous bodies the permission is to be given by the concerned department only.

Procedure for getting the investigations done by an empanelled Diagnostic centre/Hospital

The following documents are required to be submitted:
1. Self attested copy of prescription of CGHS Doctor / Government specialist
2. Copy of CGHS Card of the patient and main card holder.
3. Original Prescription and Original Cards are to be produced at the centre for verification.

Investigation can be done within 14 days of the advice only.

Procedure for getting for any treatment procedure done at an empanelled hospital

The following documents are required:
1. Self attested copy of prescription of CGHS Doctor / Government specialist
2. Copy of CGHS Card of the patient and main card holder.
3. Original Prescription and Original Cards are to be produced at the centre for verification.

Treatment procedures can be done within 3 months of the advice only.

Reference: This office Circular No. 570 dated 31.10.2016, Circular No. 582 dated 05.09.2017 and Circular No. 585 dated 21.09.2017.

Copy of GOI, MOD letter No. 17(01)/2017(01)/D(Pen/Policy) dated 23rd January, 2018 on the above subject, which is self-explanatory, is forwarded herewith for further necessary action at your end.

2. In terms of Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September’ 2017, Disability Element of Disability Pension to Armed Forces Pensioners has to be revised by multiplying the existing rate of Disability Element as had been drawn on 31.12.2015 by factor of 2.57 to arrive at revised rate of Disability Element as on 01.01.2016. Further, in terms of Para-5.2 & 5.3 of GOI, MOD letter No. 17(01)/2017 (02)/D(Pension/ Policy) dated 05th September’ 2017, Disability Pensionary awards has to be revised on notional pay fixation method and benefits of broad banding will be given to discharge cases also as in invalided out cases and these will be done by issuing Corrigendum Pension Payment Order (PPO).

3. Now, consequent upon the issue of GOI, MOD letter dated 23rd January, 2018, the cases where Armed Forces Pensioners who were retired/ discharged voluntary or otherwise with disability and they were in receipt of Disability/ War Injury Element as on 31.12.2015, their extent of disability/ War Injury Element shall be re-computed in the following manner given below, before applying the multiplication factor of 2.57 on existing disability/ war injury element as on 31.12.2015 for getting the revised disability/ war injury element as on 01.01.2016 in accordance to Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September’ 2017.

4. The Note below Para-12 of GOI, MOD letter No. 17(01)/2016-D(Pen/Pol) dated 29th October, 2016 (circulated vide Circular No. 570 dated 31.10.2016) stands deleted. In other words, quantum of additional pension available to old age pensioners after attaining the age of 80 years and above shall also be admissible on revised disability/ war injury element.

5. It is also stated that PDAs may take utmost care during revision of Disability/War Injury Element as per this order in those cases where the pensioners who are in receipt of 50% of Disability/ War Injury Element of Disability/ War Injury Pension. If the individual has already been given rounding of benefit through PPO (in invalided out cases) then rounding of benefit in such cases should not be given. However, where his disability was assessed as 50% in discharge cases then it will be rounded to 75% as mentioned in Para-3 above. If the PDAs found any problem regarding
identification of such cases the same may please be forwarded to Audit Section of this office.

6. All Pension Disbursing Agencies handling disbursement of pension to the Defence Pensioner are hereby authorized to pay benefit of rounding off disability/ war injury and additional pension as per Para 3 & 5 above without any further authorization from the concerned Pension Sanctioning Authorities.

7. Provisions of GOI, MOD letter No. 17(01)/2017(01)/D(Pen/Policy) dated 23rd January, 2018 shall take effect from 01.01.2016.

I am directed to refer to this Department’s sanction of even number dated 21.9.2017 (copy enclosed) authorizing grant in-aid in favour of 21 identified Pensioner Associations total amounting to Rs.14,16,389/- against which an amount of Rs.6,83,207/- payable to 10 Pensioner Associations, an amount of Rs.540352/- to 8 Pensioner Associations and an amount of Rs.1,25,815/- to 2 Pensioner Associations had already been released vide sanction letter of even number dated 28.9.2017, 30th October,20 17 and 6th December,20 17 respectively. This sanction is for further release of sanctioned amount of Rs.66955/-(Rupees Sixty Six Thousand Nine Hundred Fifty-Five only) in favour of under-mentioned 1 Pensioner Association on their having been registered under NITI Aayog DARPAN and having been linked with PA&O under PFMS, as per details given in Col.5 of the Table given below :-
2. This Department also undertake on behalf of respective Pensioner Associations that funds utilization towards the expenditure to be incurred on approved components will be done through EAT module mapping for which has already been done under DARP AN in PFMS module. The Pensioner Association thus needs to fulfill this undertaking given by this Department

3. The. above Pensioners Association is, therefore, advised to book the utilization of funds for approved components under the Scheme of GIA through EAT Module under PFMS. Any expenditure incurred otherwise than through EAT module will not qualify for adjustment against the Grant-in-aid being sanctioned and released and the Association will be liable to refund such amount to this Department.

4. All the Pensioners Associations can access the Eat Module under PFMS by creating log-in-id and password The Log-in-ID of each Pensioner Association is Unique ID under EAT Module of PFMS which is indicated against each Pensioner Associations in Column ‘8″ of the Table under Para’ 1′ above. For getting the password the Association need to first fill the log-in-id ( as indicated in column ‘8’ of the above Table) and use the facility of ‘Forget Password” to get the fresh Password by authenticating OTP which they will receive from PFMS on the registered mobile number and E-mail by PFMS as mentioned earlier in the agency details under PFMS. After filling the OTP sent by the PFMS, the Association will get the option of ‘Change Password’. Accordingly, the Association will be able to create the new password for Log-in-ID. If, ‘any help is needed to create log-in-ID and password in EAT module of PFMS and acquainting themselves with other functions including booking of expenditure in EAT module, they may contact this Department for arranging necessary training etc. for them. The Drawing & Disbursing Officer of the Department of Pension & Pensioners’ Welfare is authorized to draw the amount as mentioned in Col 5 of Table given in para 1 above for disbursement to the Grantee Pensioners’ Association for transferring the amount to the Bank Accounts of respective Pensioners’ Associations.

6. The expenditure involved is debitable to Major Head “2070”- Other Administrative Services 00.800.0ther Expenditure, ( Minor Head); 43-Plan Scheme of Department of Pensions and Pensioner Welfare, 43.01-Pensioners Portal; 43.01.31- Grants-in-Aid-General under Demand No.-
70 Ministry of Personnel, Public Grievances & Pensions for the year 2017-18.

7. The accounts of. the above Pensioners’ Associations shall be open to inspection by the sanctioning authority and the audit, both by the Comptroller and Auditor -General of the India under the provision of CAG (DPC) Act, 1971 and internal audit by the Principal Accounts Officer of the Department of Pension & Pensioners’ Welfare, whenever the organization is called upon to do so.

8. This sanction issues under financial powers delegated to the Ministries/Departments of the Government of India with the concurrence of Integrated Finance Division vide Diary No. Dir (F/P)/P 4625 dated 04.09.2017.

9. The expenditure of Rs.66955/-(Rupees Sixty Six Thousand Nine Hundred Fifty-Five only) has been noted in the grant-in-aid register for the year 2017-2018.

10. The release of GlA through this Sanction will be governed by the terms and conditions contained in this Department Sanction of even number dated 21.9.2017 referred to above.

Online Applications are invited around 90,000 posts in Group C Level I (Erstwhile Group D) like Track maintainer, Points man, Helper, Gateman, Porter and Group C Level II categories like Assistant Loco Pilots (ALP), Technicians (Fitter, Crane Driver, Blacksmith, Carpenter) through Railway Recruitment Boards websites.

Largest Computer based test in the World is scheduled tentatively in April – May 2018.

Educational Qualifications for various posts are class Xth passed & Industrial Training Institute certificate (ITI).

Selection procedure only includes Computer Based Test without Interviews.

Ministry of Railways has announced one of the world’s largest recruitment processes for 89409 posts in Group C Level I (Erstwhile Group D) & Level II Categories. For Group C level II posts, the monthly salary along with allowances as per the Seventh Pay Commission (level 2) Scale (19,900-63,200) will be given to the selected candidates. For Group C Level I (Erstwhile Group D) posts, the monthly salary along with allowances as per the Seventh Pay Commission (level 1) Scale (18,000- 56,900) will be given to the selected candidates. Applications for Group C Level II posts will be accepted till 5th March 2018 & for Group C Level I (Erstwhile Group D) posts will be accepted till 12th March 2018.

Disability pension and compensation to ex servicemen and cadets

Disability Pension in cases of invalidment is granted to Armed Forces Personnel irrespective of qualifying service rendered which consists of service element and disability element. Armed Forces personnel who are retired / discharged with disability which is attributable to or aggravated by military service are also allowed disability element in addition to their service / retiring pension. With effect from 01.01.2006, the Disability Element is paid based on 30% of last emoluments drawn for 100% disability which is reduced pro-rata for lower percentages of disability.

Benefit of broad banding of percentage of disability was earlier allowed only for those invalided out from service. However, vide Ministry of Defence orders dated 4th and 5th September, 2017 the benefit of broad banding of percentage of disability has been extended to cases of retirement / discharge from service with disability of 20% or more.

Cadets during the entire duration of training in service academies i.e. during training period of Indian Military Academy (IMA) and Officers Training Academy (OTA) are entitled to stipend. The period of training is not treated as Commissioned Service. Cadets are not entitled to Disability Pension.

The scheme for grant of monthly ex-gratia awards in cases of death / disablement of Cadets (Direct) due to causes attributable to or aggravated by Military Training was introduced vide Ministry of Defence letter dated 16.04.1996 which was applicable with effect from 01.01.1986. Rates of Ex-gratia awards have been revised by each Pay Commission. The rates notified vide Ministry of Defence letter dated 04.09.2017, are as follows:-

In case of disablement:-
Monthly Ex-gratia amount: Rs.9,000/-pm.
Monthly Ex-gratia disability award: Rs.16,200/-pm for 100% disability, subject to pro-rata reduction for lower percentages of disability.

Constant Attendance Allowance: Rs.6,750/-pm, if applicable.

In case of death:-
Monthly Ex-gratia amount: Rs.9,000/-pm.
Ex-gratia lump sum compensation: Rs.12.5 lakhs.

Make the Delhi demonstrations on 15.02.2018 a grand success.

At the outset we congratulate the affiliated Unions of the three Federations and the other Unions and Associations and the entire Defence Civilian Employees for effectively observing “Defence Industry Protection on Week” from 08.01.2018 to 12.01.2018. We are also happy to know that after the above programme the Unions are continuing their propaganda and compaigning against the retrograde policy decisions being taken by the Government against the interest of Defence Industry and its Employees. As per the decision already taken we have to successfully organize the Massive Demonstration at Delhi on 15.02.2018. We have already applied for permission with the Police Authorities for holding the demonstration at Parliament Street, New Delhi. We request the Unions in and around Delhi and nearby States to organize in large number for the demonstration. Unions from other places may also take efforts to mobilize the maximum number of Employees for the demonstration. The demonstration will start at 9.30 AM and concluded by 14.00 hrs.

Strike Ballot to be taken by affiliated Unions of 5 OEF Group of Factories, 8 ABWs, 14 Station Workshops, 39 Military Farms, 4 Depots and MES

As decided jointly by the three Federations the above Establishments have to observe “One Day Call Attention Strike” on 15th March, 2018. For this purpose all the affiliated Unions functioning in these units have to take Strike Ballot as per the schedule given below:

a) 21.02.2018 - Strike Ballot by AIDEF Unions
b) 22.02.2018 - Strike Ballot by INDWF Unions
c) 23.02.2018 - Strike Ballot by BPMS Unions

Other Unions in your area / Unit may take Strike Ballots on 19th or 20th of February, 2018 according to local convenience. The following will be the demands for the Strike and the Strike Ballot.
a) To withdraw the decision taken by Ministry of Defence to declare the products being manufactured in the Ordnance Factories as “Non-Core” and to outsource the same.

b) To withdraw the Government Orders for granting Rs. 10,000/- as Uniform Allowance in place of stitched uniforms affecting the 5 OEF Group of Factories and its nearly 10,000 Employees including almost 2000 Women Employees. The decision to further declare 39 itmes of OEF Group of Factories including Army Logo Uniform and Parachutes etc. as “Non-Core” itmes inspite of the commitment given by DDP may be withdrawn.

c) To withdraw the decision to close down 14 Station Workshops under EME and convert Army Base Workshops into GOCO Model.

d) To withdraw the decision to close down 4 Depots under DGOS and 39 Military Farms.

e) To withdraw the decision of declaring more than 31000 Defence Civilian Employees of Army Units Surplus including in MES.

f) Stop outsourcing of permanent and perennial jobs in MES and fillup all the vacant posts.

The affiliated Unions may keep informed their respective Federations about the result of the Strike Ballot. The Model Strike Notice etc. will be forwarded to all the Unions separately.

The three Federations once again appeal to all the Unions and Associations to remain united and continue the compaigning programmes and also to carry forward the struggle till we achieve our goal of saving the Defence Industry from the present crisis.
